A woman handcuffed naked by a Chandler police officer who entered her home illegally is planning to file a lawsuit against the city. “I felt helpless. I felt violated. And honestly, I felt molested,” said Esmeralda Rossi. Chandler Police launched an internal investigation after the incident. One of the officers involved retired in the middle of that investigation. Police arrived at Rossi’s home after receiving a call about an argument between her and her estranged husband. “I was in the shower,” Rossi said. “My daughter came to the shower and said there are two officers at the door. So I just grabbed a towel.” When she answered the door, there were two Chandler Police officers. One of those officers was Doug Rose. Rossi said Rose became very aggressive and she told him to wait at the door so she could go get a cell phone. “It made me very uncomfortable,” Rossi said. “So I closed the door. I turn to go into my living room, and I probably get about five steps in; and all of a sudden, I just hear boots running in after me, telling me stop or I’ll arrest you.” At that point, both Rossi and her daughter begin recording. That’s when things turned south. WATCH WHAT HAPPENS IN THE VIDEO ABOVE. “This was not the proper treatment of a citizen,” said Marc Victor, Rossi’s attorney. “This was disgusting. This was barbaric.” Police records show that investigators believed Rossi was trying to agitate Rose. Rossi also admits she took an attitude with the officer after he illegally entered her home. “Any one of us would be upset if a police officer barged into our homes without permission,” Victor said. “She had a right to be upset.” READ THE CHANDLER POLICE INTERNAL INVESTIGATION The cell phone video was influential evidence in the internal investigation. Unedited copies were provided to ABC15 by Rossi and her attorney. Rossi was never charged with a crime, records show. After reviewing the incident, Chandler Police internal investigators determined Rose entered the home illegally and without probable cause. The investigation also determined that Rose didn’t document arresting or un-arresting the woman or the fact that she was naked. There was also no video from his body camera for the call, records show. After the incident, the other officer involved immediately contacted his supervisor to raise questions about Rose’s actions. The second officer was cleared of wrongdoing. Chandler Police declined to comment, citing the potential lawsuit. Rossi admits she gave the officer attitude, but her attorney says the video starts after Rose had already illegally entered her home. SANTA CLARA — A San Jose woman will receive a $6.7 million settlement from the city of Santa Clara after her leg was broken trying to prevent police officers from entering her home without a warrant to arrest her teenage daughter last year, her attorney and the city announced Wednesday. The settlement resolves a federal civil-rights lawsuit filed on behalf of Danielle Burfine, who was injured on April 12, 2016 at her home in the Rose Garden neighborhood of San Jose. She refused entry to Santa Clara officers who identified her 15-year-old daughter as one of two suspects in the arson of a snack shack at Santa Clara High School eight days earlier that caused $350,000 in damage. A Santa Clara police sergeant kicked in the front door and at some point Burfine, whose last name was Harmon when the lawsuit was filed last year, fell to the the ground — the sides disagree on whether she was thrown — and her leg hit a stone pillar. Her daughter was later located upstairs in the home and arrested, and later convicted in the arson. On Wednesday, attorney Michael Haddad released body-camera footage recorded by one of the responding officers, and it depicts Burfine screaming in pain for most of the 12-minute video. Haddad added that Burfine developed Complex Regional Pain Syndrome, a chronic pain condition he said “is likely to be permanently disabling.” “This shocking video shows obvious excessive force, wrongful entry without a warrant, and extreme callousness as Danielle broke her ankle and cried in pain,” Haddad said. The Santa Clara City Council approved the settlement Tuesday. “Although there was significant disagreement about the extent of the injury, there was no dispute that the plaintiff sustained a broken ankle in the course of the entry to the plaintiff’s home without a warrant,’’ City Attorney Brian Doyle said in a statement. “The city’s insurer determined that the most prudent course of action was for it to pay an amount that would result in the settlement.”
An Arizona cop barged into a woman’s home while she was in the shower and handcuffed her as she stood naked and sopping wet, according to a lawsuit. Officer Doug Rose lectured an unclothed, sobbing Esmeralda Rossi in front of her daughter and told her he was in charge, even though she was in her own home. Even as an investigation determined that Rose illegally entered the home, the policeman managed to retire and start collecting his pension. Rossi is now suing the city of Chandler, Ariz., for the aggressive invasion her daughter caught on camera..
